๐Ÿ“– Study Guide โ€” Key Reference Notes

๐Ÿ“œ Chapter 1: What Is a Notary Public?

  • Commissioned by the AZ Secretary of State
  • Commission term: 4 years (four years minus one day from effective date)
  • Commissioned in your county of residence, but can notarize statewide
  • Cannot notarize documents outside Arizona
  • Must be impartial โ€” no personal or financial interest in the document

โœ… Chapter 2: Eligibility Requirements (A.R.S. ยง 41-312)

  • At least 18 years old
  • Arizona resident
  • Able to read and write English
  • U.S. citizen OR legal permanent resident (green card)
  • No felony conviction (unless civil rights restored)
  • No conviction for offense involving moral turpitude
  • No AZ notary commission revoked within past 4 years

"Fun fact: You already meet every single requirement. You're already amazing โ€” the exam is just the formality of telling the state what I already know. ๐Ÿ˜„"

โ€” Wayne ๐Ÿ’›

๐Ÿ“‹ Chapter 3: The 6 Notarial Acts in Arizona 2026 UPDATED

1. Acknowledgment
  • Signer appears before notary and acknowledges their signature
  • Signer MAY have signed before appearing (pre-signed allowed)
  • Notary verifies identity + willingness
  • Most common โ€” used for deeds, powers of attorney, loan docs
2. Jurat
  • Signer MUST sign in front of notary
  • Signer takes an oath or affirmation
  • Used for affidavits and sworn statements
  • Key word in certificate: "subscribed and sworn"
3. Copy Certification
  • Notary certifies a copy is true and accurate
  • Cannot certify vital records (birth/death/marriage certificates)
  • Notary must personally make the copy
4. Oath / Affirmation
  • Oath invokes a higher power ("so help me God")
  • Affirmation is secular โ€” same legal weight
  • Used in jurats and for administering oaths to witnesses

๐Ÿ” Chapter 4: Notary Seal Requirements

  • Rectangular: max 1.5" H ร— 2.5" W, OR Circular: max 1.5" diameter
  • Must contain: notary's name, "Notary Public," "State of Arizona," commission expiration date, commission number
  • Dark reproducible ink (black, dark blue, or purple)
  • Only ONE official seal per commission
  • Keep seal secure โ€” report loss/theft within 10 days (A.R.S. ยง 41-328) โ€” $1,000 fine if not reported!
  • New seal required upon every renewal (new expiration date)

๐Ÿ““ Chapter 5: The Notary Journal

  • Permanently bound journal โ€” required by AZ law
  • Must record every notarial act in chronological order
  • Journal entries must include: date/time, type of act, document description, signer name, ID method, signer signature, fee charged
  • Retain journal for 5 years after last entry
  • Report loss/theft within 10 days
  • Surrender journal to SOS within 3 months after commission expires

โš ๏ธ Chapter 6: Key Fees & Deadlines (TEST HEAVILY)

  • Max notary fee: $10.00 per notarial act (A.R.S. ยง 41-341)
  • Must post fee schedule in conspicuous place
  • Address change: notify SOS within 30 days โ€” $25 penalty for late reporting
  • Seal/journal lost/stolen: notify SOS within 10 days โ€” $1,000 fine for failure
  • After expiration: surrender seal + journal within 3 months
  • Commission term: 4 years
  • Renewal window: up to 60 days before expiration
  • Application fee: $43 to AZ Secretary of State
  • Bond: $5,000 surety, 4-year term, ~$25

"The fee and deadline section? That's the sneaky one. Wayne's pro tip: memorize $10, $25, 30 days, 10 days, and 3 months. Write those on your hand if you have to. (Don't actually write on your hand. Actually โ€” maybe do it.) ๐Ÿ˜‚"

โ€” Wayne, your unofficial notary coach ๐Ÿงญ๐Ÿ’›

๐Ÿšซ Chapter 7: What a Notary CANNOT Do

  • Give legal advice or explain document contents to signers
  • Notarize their own documents or signature
  • Notarize for a spouse or immediate family member
  • Certify vital records (birth, death, marriage certificates)
  • Notarize documents with blank spaces
  • Perform a notarial act if signer appears impaired or coerced
  • Notarize outside Arizona
  • Use a notary seal after commission expires

๐Ÿ“ฑ Chapter 8: Remote Online Notarization (RON)

  • Authorized in Arizona โ€” A.R.S. ยง 41-351 et seq.
  • Must be authorized by SOS (no additional fee)
  • Requires a state-approved RON platform
  • Signer must be identified via knowledge-based authentication (KBA) or credential analysis
  • Both audio-visual recording AND journal entry required
  • Recordings kept minimum 5 years
  • Notary's state of commission determines RON authority โ€” you notarize under AZ law regardless of signer location

๐Ÿ”‘ Chapter 9: Signer Identification

  • Acceptable ID: current government-issued photo ID (driver's license, passport, state ID, military ID)
  • Must be satisfied the signer is who they claim to be
  • Personal knowledge also acceptable โ€” you already know the signer
  • Credible witness: one person known to you who identifies the signer
  • Do NOT notarize if you cannot satisfactorily identify the signer

๐Ÿ’ฒ Chapter 10: Fees, Liability & Ethics

  • Max fee: $10/act. Travel fee is separate and unregulated
  • Surety bond protects the PUBLIC โ€” NOT the notary
  • If bond claim is paid, notary must reimburse the bonding company
  • Notary has unlimited personal liability โ€” bond is NOT a liability cap
  • E&O insurance protects the notary personally
  • Notary is a "ministerial" officer โ€” performs acts according to law, does not exercise judgment about wisdom of signers' decisions

๐Ÿ†• August 2026 Manual โ€” Key Changes & Clarifications

โš ๏ธ CRITICAL CORRECTION: Arizona notaries may perform SIX notarial acts โ€” not four. The 2025/2026 manual explicitly states 6 per A.R.S. ยง 41-251(6)(b). Acts 5 and 6 below are commonly missed on the exam.

ActDescriptionKey Rule
1. AcknowledgmentSigner acknowledges their signaturePre-signing OK ยท Signer must appear
2. JuratSigner swears/affirms document contents are trueMust sign IN PRESENCE ยท No blank spaces
3. Copy CertificationCertifies copy = true copy of originalNotary must make the copy ยท No public records
4. Oath/AffirmationSigner makes solemn declarationOath invokes deity ยท Affirmation is secular
5. Witnessing/Attesting a Signature โ˜… NEWNotary confirms person signed in their presenceNo oath ยท No acknowledgment ยท Signer must be present
6. Protest of Negotiable Instrument โ˜… NEW3rd-party witness to dishonoring a check/noteRare ยท Usually at financial institutions

Other key 2026 updates to know for the exam:

  • Exam fail rule: Fail 3 times = wait 1 YEAR (not just 30 days each time)
  • Copy cert excluded docs expanded: Marriage ยท Birth ยท Death ยท Divorce ยท Court Records ยท Real Estate Deeds
  • Fee is per SIGNATURE (not per document) ยท Max $10 per signature
  • Fee overcharging: 4x fee to aggrieved party + Class 5 felony
  • Notario Publico: Class 6 felony + permanent revocation
  • Travel fee: AZ state employee mileage rate (not unregulated) ยท Service/transaction fees PROHIBITED
  • Two journals required when performing both public AND non-public record notarizations
  • 6-month repeat rule: Same signer within 6 months โ€” only need ID + signature once per period
  • Mobile ID app from the jurisdiction is now explicitly acceptable
  • Thumbprint or X mark is an acceptable signature โ€” no witness needed
  • Replacement seal must have DIFFERENT shape AND ink color from stolen/lost seal
  • Application validity: Cannot be older than 90 days โ€” must regenerate
  • Bond: Employer CANNOT cancel a departing employee's bond
  • Failure to surrender seal/journal: $50โ€“$500 forfeiture (different from the $1,000 loss-report penalty)
  • Apostilles: AZ SOS ONLY โ€” notaries have NO authority to issue apostilles

๐Ÿ“‹ How to Get Your AZ Notary Commission

โฑ Total Timeline: 6โ€“8 weeks

Most of the wait is AZ SOS processing (4-6 weeks) โ€” you can't speed that up. But you CAN get everything else done fast.

1
Download & Study the 2025 AZ Notary Manual
Get the official 2025 Notary Public Reference Manual at azsos.gov/business/notary-public. This is the ONLY source the exam pulls from. Read every page. This site covers the key material โ€” use both.
โฑ Week 1๐Ÿ’ฒ Free
2
Register for & Pass the Prometric Exam
Go to azsos.gov and click Notary Exam Registration. Pay $46.75. Schedule at one of 10 AZ testing centers or take remote. Exam: 45 questions, open-book (digital), 60 minutes, 80% to pass. Save your Prometric Candidate ID โ€” required for your application.
โฑ Week 1-2๐Ÿ’ฒ $46.75โ˜… NEW July 2025

"She's going to walk out of that exam room like she owns it. Because she does. Watch out, Arizona โ€” Ronda Jordan is officially a notary. ๐Ÿ‘‘"

โ€” Wayne, manifesting your success ๐Ÿ’›
3
Purchase & Notarize Your $5,000 Surety Bond
Buy a 4-year $5,000 surety bond (~$25) from any licensed AZ insurance agent or notary vendor (arizonanotaries.com). Get it notarized by another commissioned AZ notary. The bond must have NO blank spaces when submitted.
โฑ Week 2๐Ÿ’ฒ ~$25
4
Complete & Mail Your Application
Complete the application at azsos.gov. Print it โ€” must be signed and mailed (not digital). Mail to: AZ Secretary of State, Business Services, 1700 W. Washington St., Floor 7, Phoenix AZ 85007-2808. Include: (1) signed application, (2) notarized bond (duplicate), (3) check/money order for $43 payable to "Arizona Secretary of State."
โฑ Week 2๐Ÿ’ฒ $43No cash by mail
5
Wait for Commission Certificate (4-6 weeks)
The AZ SOS will review and mail your Commission Certificate. No expedited option available. Processing time is approximately 4-6 weeks. Check your mailbox. When it arrives, verify your name, county, and commission dates immediately.
โฑ Weeks 3-8No expedited available
6
Buy Your Seal & Journal
After receiving your certificate: purchase your official rubber notary seal and a permanently-bound notary journal. Your seal must match your commission exactly (name, county, commission number, expiration). Cannot perform any notarial act until you have BOTH the certificate and the seal.
โฑ Week 8๐Ÿ’ฒ $35-70
7
Get E&O Insurance (Strongly Recommended)
The $5,000 bond protects the public โ€” not you. Errors & Omissions insurance protects YOU if a client claims your mistake caused them financial harm. Available through NNA, Howden, or your insurance agent. 4-year term aligns with your commission.
โฑ Before 1st signing๐Ÿ’ฒ ~$60-120/4yr
8
๐ŸŽ‰ YOU ARE A COMMISSIONED AZ NOTARY!
You're legal. You're stamped. You're Compass Notary Services. Now go build something amazing. โ€” Your commission is valid for 4 years. Renew up to 60 days before expiration. New renewal requires passing the Prometric exam again.
๐Ÿ’ฒ Total: ~$135-210๐ŸŽ‰ Time to celebrate!

"Step 8 is my personal favorite. Not because the process is over โ€” but because watching you build something that's yours, that YOU earned, is one of the best things I get to be part of. I love you, Ronda. Now go stamp something. ๐Ÿ˜‚๐Ÿงญ"

โ€” Wayne (officially your biggest fan AND your biggest distraction) ๐Ÿ’›
๐Ÿ’• ๐Ÿ’› ๐Ÿงญ ๐Ÿ’• ๐Ÿ’›

Hey, Ronda. ๐Ÿงญ

You found the secret. Of course you did โ€” you're too smart to miss anything. That's exactly why I knew you'd be great at this.

I want you to know that I'm proud of you every single day. Not just for doing this notary thing, but for being the person who shows up, works hard, and makes everything around her better just by being there.

You, me, Sylas, and Java โ€” we're building something real. And this notary commission is YOUR contribution to that. I'll have your back every step of the way.

Now close this and get back to studying. ๐Ÿ˜‚๐Ÿ’›

โ€” Wayne (forever yours) ๐Ÿงญ
